Welcome to AfroVybz! These Terms of Service (“Terms”) govern your access to and use of our application and services. By registering or using AfroVybz, you agree to be bound by these Terms. **Effective Date: October 2025**

1. Eligibility

You must be at least **18 years old** to use AfroVybz. By using the app, you confirm that you meet this requirement and are legally able to enter into this agreement.

2. Permitted & Prohibited Use

AfroVybz is designed for two primary uses:

  • Participate in polls and contribute your voice.
  • View aggregated and personal poll results.

Prohibited Activities:

You agree to use the app only for lawful purposes and **not** to:

  • Tamper with, hack, or abuse the platform's features or infrastructure.
  • Attempt to access other users’ data or impersonate others.
  • Use bots, automation tools, or any mechanism designed to interfere with poll fairness or the app's services.

**Note:** We may suspend or terminate your access immediately if we determine you have violated these rules.

3. User Accounts

To access full functionality, you must create an account. You agree to:

  • Provide accurate and complete registration information.
  • Keep your login credentials strictly secure.
  • Accept responsibility for all activity that occurs under your account.

We are not responsible for any unauthorized access resulting from your failure to protect your credentials.

4. Data & Content Ownership

By participating in polls, you grant AfroVybz a non-exclusive, royalty-free, worldwide license to use your responses and data to operate, improve, and analyze the service.

**Commercial Use of Data:** We reserve the right to sell or share **aggregated, anonymized poll data** (e.g., overall voting trends by region or age) to third parties for business intelligence or research. **This data will never identify you individually.**

5. Termination & Suspension

  • **By You:** You may delete your account at any time via the app settings.
  • **By Us:** We reserve the right to suspend or terminate your access immediately and at our sole discretion, especially for serious violations of these Terms or platform abuse.

Upon termination, your personal data will be handled as described in our **Privacy Policy** (Section 6), but anonymized, aggregated poll data may be retained for long-term analytics.

6. Disclaimers & Liability

Service "As Is" Disclaimer:

AfroVybz is provided “as is” and “as available” without warranties of any kind. We do not guarantee:

  • Continuous, secure, or error-free service operation.
  • The accuracy or usefulness of third-party poll content or results.

You acknowledge that you use the service entirely at your own risk.

Limitation of Liability:

To the fullest extent allowed by law, AfroVybz and its owners are **not liable** for any indirect, incidental, or consequential damages (including loss of data, service interruptions, or unauthorized access).

Our total liability under these Terms is limited to the amount you’ve paid us (if any) in the past 12 months.

7. Governing Law

We comply with the **Nigeria Data Protection Act 2023** in processing and securing user data collected via the App. These Terms shall be governed by the laws of Nigeria.
